11/30 NOTE TO FILE FOR PETER KELLEY

Peter Kelley needs to be called in for a written warning, we attempted to have an in-person discussion today, but Peter left without communication to MOD. Kristy and myself were prepared with the "Rules of Conduct" printed out to discuss the three areas of concern regarding Peter Kelley.

1) Insubordination, refusal, failure or inability to comply with reasonable instructions of supervisor or managers

2) Refusal to comply with company rules, policies or proceedures, including failure to cooperate in a company investigation

3) Poor job performance, includijng unsatisfactory attitude that detracts from job performance or efficent operation of the company

The resaon for sighting these "Rules of Conduct" is due to the following:

Peter has over the past few shifts been dismissive or insubordinant to his direct Supervisors requests to do the work of busser. A few examples of the requests by Kristy on 11/29 were:

"discussing bussing more frequently, and staying on top of it, not sitting at the actual bar, showing him some dish pit etiquette, and putting items in correctly on the glass racks etc. I needed to ask him to sweep, help set up the group of 14, take a lap around the pool, specifically busser duties"

Combative behavior regarding break policy, Peter has argued and complained to Kristy and Shelby at front desk about policy re: meal break. As outlined by the handbook, if you do not exceed 6 hours of work, you may waive your meal period. Peter has completed and signed off on this waiver in his file. If Peter has some issues, he needs to go through the proper channels, which have been explained to him in the meeting on 11/19 and in person with Warner and Jessica on Nov. 16th. It is inappropriate to challenge the policies on the floor with you MOD and it is VERY inappropriate to go to other departments that are not HR or F&B and distract, disrupt and dump your frustrations.

Poor job performance, Peter gets distracted and is inconsistant with his quality of work. He is often missing from the floor, there have been complaints by pastry that he is eating in the kitchen or distracting pastry, there are complaints by his MOD that he disappears for 10 min at a time and can't be found, the expectation is that when you are on the clock you are on the floor unless otherwise on a 10 min approved break.

I recommend a written warning be issued, I suggest we call Peter in the week of 12/1 to have this conversation.

The above has been submitted via UKG, I also asked Shelby who came to complain about multiple incidences with Peter to note in UKG.
